§1 Scope
These General Terms and Conditions apply exclusively to orders placed through the Löffler ERGO GmbH online shop (hereinafter referred to as the “Online Shop”).
You can print or save these General Terms and Conditions using the usual functions of your internet browser (e.g. Firefox, Chrome, Safari).
The version of these General Terms and Conditions applicable at the time the order is placed shall apply.

§3 General Information / Conclusion of Contract
These General Terms and Conditions apply to all orders placed through the Online Shop in the version applicable at the time the order is placed.
Any terms and conditions of the customer that deviate from these General Terms and Conditions shall only apply if expressly agreed by Löffler ERGO GmbH in writing.
1. Customers
Customers may be both consumers and entrepreneurs.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activities (§ 13 BGB).
An entrepreneur is a natural or legal person or a legal partnership that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction (§ 14 BGB).
2. Product presentation and conclusion of the contract
The presentation of products in the Online Shop does not constitute a legally binding offer. It is a non-binding presentation of the products available through the Online Shop.
By clicking the “Place order with obligation to pay” button, the customer submits a binding order for the products contained in their shopping cart.
After the order has been submitted, the customer will receive an automatic confirmation of receipt by email. This automatic confirmation merely confirms that the order has been received and does not constitute acceptance of the customer's offer.
The purchase contract is concluded only when Löffler ERGO GmbH sends a separate order confirmation by email.
The contract text is stored in compliance with applicable data protection regulations. The order details and these General Terms and Conditions will be sent to the customer by email.
3. Product availability
If a product selected by the customer is not available at the time the order is placed, the customer will be informed accordingly.
If a product is permanently unavailable, Löffler ERGO GmbH will not issue an acceptance declaration for that product. In this case, no purchase contract for the unavailable product will be concluded.
4. Contract language
The contract language is German.
5. Minimum age
We do not offer products for purchase by minors. If you are under 18 years of age, you may only place an order with the involvement of your legal representative.
§4 Delivery / Shipping Costs
All prices shown in the Online Shop are gross prices and include the statutory VAT applicable at the time of purchase.
Any applicable shipping costs will be displayed separately during the ordering process and before the customer submits the binding order.
The prices applicable at the time the order is placed shall apply.
§5 Delivery / Shipping Costs
1. Delivery countries and delivery times
We currently deliver to the following countries:
- France
- Belgium
- Netherlands
- Luxembourg
- Poland
- Hungary
- Slovakia
- Czech Republic
- Austria
- Switzerland
Delivery is free of shipping charges for the customer unless otherwise stated in the Online Shop or in the order confirmation.
Delivery times may vary depending on the destination country.
Unless a different delivery period is indicated for the respective product in the Online Shop, the regular delivery time is approximately 15–25 working days.
The delivery period begins after the order confirmation has been issued, provided that payment of the purchase price has been made in advance, except in the case of purchase on account.
Unless expressly stated otherwise, all delivery times are non-binding.
2. Delivery method
Ordered goods are delivered by a forwarding agent or another parcel service providing curbside delivery.
Unless otherwise agreed, we are not obliged to unpack, install or assemble the goods
3. Partial deliveries
Partial deliveries are permissible if they are reasonable for the customer and do not result in additional shipping costs for the customer.
4. Collection from our premises
Orders are delivered exclusively by shipping.
However, customers may collect their furniture in person from our headquarters in Reichenschwand, near Nuremberg, by prior appointment.
Our opening hours are Monday to Friday, from 8:00 a.m. to 5:00 p.m.
Please contact us in advance to arrange a collection appointment.
5. Parcel lockers
We do not deliver to parcel lockers or Packstationen.
6. Delivery delays
If a communicated delivery date is not met, or is only partially met, the customer shall not be entitled to claim damages solely as a result of the delay, subject to any mandatory statutory rights.
Costs incurred by the customer as a result of a delayed delivery, such as rental costs for replacement chairs, shall not be charged to Löffler ERGO GmbH unless otherwise required by applicable law.
Unless expressly agreed otherwise, all stated delivery dates are non-binding.
§6 Customs Clearance, Customs Duties, and Taxes
For deliveries to countries outside the European Union, customs duties, import taxes and other charges may apply once the goods reach the destination country.
1. Customs declarations
For shipments to countries outside the European Union, the value and type of the goods contained in the shipment may be stated on the relevant customs documentation.
We reserve the right to provide such information where necessary to facilitate customs clearance or to comply with legal requirements.
2. Customs inspections
Customs authorities may open and inspect packages. Löffler ERGO GmbH has no control over such inspections.
3. Customs and import duties
Any customs duties, import duties, import taxes or other charges imposed by the destination country are the responsibility of the customer unless otherwise stated.
4. Customs clearance fees
Any fees charged for customs clearance are the responsibility of the customer.
Löffler ERGO GmbH has no control over such fees and cannot predict their amount.
5. Local customs regulations
Customs regulations vary from country to country. Customers are responsible for informing themselves about the applicable customs and import regulations and may contact their local customs authority for further information.
For orders delivered outside the European Union, the customer may be considered the importer of record and is responsible for complying with the laws and regulations applicable in the destination country.
§7 Payment
The payment methods available through the Online Shop may include:
- Advance payment
- Credit card
- PayPal
- Invoice
- Instant transfer
The payment methods available for a particular order are displayed during the ordering process. Löffler ERGO GmbH reserves the right to offer or restrict certain payment methods for individual orders and may refer customers to other available payment methods.
There is no entitlement to a specific payment method.
Payments are accepted only from accounts within the European Union.
§8 Retention of Title
Ownership of the delivered goods shall remain with Löffler ERGO GmbH until the purchase price and all other outstanding claims arising from the respective purchase contract have been paid in full.
Until ownership has passed to the customer, the customer is obliged to handle the goods with due care and to ensure that any third parties who have access to the goods also handle them with due care.
§9 Transport Damages
1. Business customers
If the customer is an entrepreneur, the risk of accidental loss or deterioration of the goods shall pass to the customer upon delivery in accordance with the applicable statutory provisions.
This also applies to partial deliveries.
2. Consumers
If the customer is a consumer, the risk of accidental loss or deterioration of the goods shall pass to the customer only when the goods are handed over to the customer or to a third party designated by the customer who is not the carrier.
§10 Warranty
The statutory warranty provisions apply.
The customer's statutory rights in the event of defects remain unaffected.
§11 Liability for Damages
Löffler ERGO GmbH shall be liable in accordance with the applicable statutory provisions.
Customer claims for damages are excluded to the extent permitted by law, except in cases involving injury to life, body or health.
Mandatory statutory liability provisions remain unaffected.
§12 Cancellation Policy
Right of Withdrawal
Consumers have a statutory right of withdrawal in accordance with § 312g BGB.
The withdrawal period is fourteen days.
You have the right to withdraw from this contract within fourteen days without giving any reason.
In the case of a purchase contract, the withdrawal period begins on the day on which you, or a third party designated by you who is not the carrier, take possession of the goods.
In the case of a contract concerning several goods ordered as part of a single order and delivered separately, the withdrawal period begins on the day on which you, or a third party designated by you who is not the carrier, take possession of the last item.
In the case of a contract for the delivery of goods in several partial shipments or pieces, the withdrawal period begins on the day on which you, or a third party designated by you who is not the carrier, take possession of the last partial shipment or the last piece.

of your decision to withdraw from this contract by means of a clear statement.
You may use the model withdrawal form provided below, although this is not mandatory.
If the Online Shop provides a dedicated withdrawal function, you may also submit your withdrawal electronically through the Online Shop. If you do so, we will promptly confirm receipt of your withdrawal by email.
To meet the withdrawal deadline, it is sufficient to send your notification of exercising the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs, without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal.
This does not include any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us.
For the reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. You will not be charged any fees for the reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs earlier.

You must return the goods without undue delay and, in any event, no later than fourteen days from the day on which you informed us of your withdrawal.
The deadline is met if you send the goods before the fourteen-day period has expired.
We bear the costs of the return shipment for the following countries:

You are liable for any diminished value of the goods only if this loss in value results from handling that was not necessary to examine the nature, properties and functioning of the goods.
§13 Applicable law
1. Applicable law
German law shall apply, subject to mandatory provisions of the law of the country in which the consumer has their habitual residence, where applicable.
2. Jurisdiction for business customers
For disputes with business customers, the place of jurisdiction shall be Reichenschwand, Germany, to the extent permitted by law.
This jurisdiction clause does not apply to disputes with consumers.
