§1 Scope

These General Terms and Conditions apply to your registration with and orders placed through Löffler GmbH. You can print or save this document by using the usual function of your internet browser (e.g., FireFox, Chrome, Internet Explorer: usually "File" -> "Save as"). The following terms and conditions apply to all orders placed through our online shop.

§3 General Information / Conclusion of Contract

The following General Terms and Conditions apply to all orders placed with Löffler ERGO GmbH—including those submitted via the online shop—Industriestraße 5, 91217 Hersbruck (hereinafter referred to as "we"), in the version in effect at the time the order is placed. Deviating conditions of the customer are not accepted unless expressly agreed upon in writing on a case-by-case basis.

  1. Customers can be both entrepreneurs and consumers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activities (§ 13 BGB). An entrepreneur is a natural or legal person or a legal partnership that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction (§ 14 BGB).
  2. All products presented—whether in the online shop, printed materials, PDF files, flyers, or digital price lists—do not constitute a legally binding offer, but merely a non-binding overview of the product range. In our online shop: By clicking the "place order with obligation to pay" button, the customer submits a binding order for the items in the shopping cart. Confirmation of receipt of the order is sent immediately by email after the order has been submitted. This automatic confirmation merely documents that the customer’s order has been received and does not constitute acceptance of the offer. The purchase contract is concluded only upon our separate order confirmation, which is sent in a separate email. The contract text is stored in compliance with data protection regulations, and the order details along with the General Terms and Conditions are sent to the customer by email. The same applies to orders placed by post, telephone, or email.

  3. If the selected product is not available at the time of the customer's order, we will inform the customer immediately in the order confirmation. If the product is permanently unavailable, we will not issue a declaration of acceptance. In this case, no contract will be concluded.
  4. The contract language is German.
  5. We do not offer products for purchase by minors. If you are under 18 years old, parental involvement is required.

§4 Delivery / Shipping Costs

  1. Delivery to the following countries is free of shipping charges for the customer, or as specified in our order confirmation: France, Belgium, Netherlands, Luxembourg, Poland, Hungary, Slovakia, Czech Republic, Austria, Switzerland. Delivery times may vary by country. The delivery times stated by us are calculated from the time of our order confirmation, provided that payment of the purchase price has been made in advance (except for purchase on account). Unless a specific or different delivery time is indicated for the respective product in our online shop, the regular delivery time is approximately 15–25 working days. All stated delivery times are non-binding.
  2. Customs duties and taxes may apply to deliveries outside the EU once the package reaches its destination. Any additional fees for customs clearance must be borne by the customer; we have no control over these charges.
  3. Customs regulations vary greatly from country to country. The customer should contact their local customs office for further information. The customer is considered the importer of record for orders placed with Löffler ERGO GmbH and must comply with all laws and regulations of the country in which the products are received.
  4. Delivery of ordered goods is via a forwarding agent or another parcel service providing free curbside delivery. We are not obliged to unpack, set up, or assemble the goods unless otherwise agreed upon.
  5. Partial deliveries are permissible if they are reasonable for the customer and do not incur additional shipping costs for the customer.
  6. We deliver exclusively by shipping. However, you are very welcome to pick up your furniture in person at our headquarters in Reichenschwand (near Nuremberg). We look forward to your visit and kindly ask that you schedule an appointment in advance. Our opening hours are Monday to Friday from 8:00 a.m. to 5:00 p.m.
  7. We do not deliver to parcel lockers (Packstationen).
  8. If a communicated delivery date is not met, or only partially met, the buyer is not entitled to claim damages. Furthermore, any costs incurred—such as for rental chairs—may not be charged to Löffler ERGO GmbH. All stated delivery dates are generally non-binding.

§5 Customs Clearance, Customs Duties, and Taxes

  1. In customs forms for parcels to countries outside the EU, the value of the articles contained in the delivery will be listed according to product type. We reserve the right to provide such information to simplify the process for our customers or to comply with legal requirements.
  2. Customs authorities may open packages for inspection; we have no control over this.
  3. Customs or import duties are levied once the package reaches the destination country.
  4. Customs clearance fees are the responsibility of the customer.
  5. We have no control over these fees and cannot predict their amount.
  6. Customs regulations vary greatly from country to country. Please contact your local customs office for more information.

§6 Payment
Payment is made via advance payment, PayPal, instant transfer, invoice or credit card. For more details on payment options, see our Payment Conditions page.

  1. All prices are gross prices and include the statutory VAT.
  2. The payment methods available to you are prepayment, credit card, PayPal, invoice and instant transfer. However, we reserve the right to offer certain payment methods for each order and refer to other cost-free options. There is no entitlement to a specific payment method.
  3. We only accept payments from accounts within the European Union.

§7 Retention of Title

  1. Ownership of all delivered items remains reserved until full payment of all outstanding claims by Löffler ERGO GmbH against the customer has been received.
  2. Until payment has been made in full, the customer is obligated to handle the goods with due care and to ensure that any third parties granted access to the goods also treat them with care.

§8 Transport Damages

  1. If the customer is an entrepreneur, delivery is at the customer’s risk. This also applies to partial deliveries.
  2. If the customer is a consumer, the risk of accidental loss or deterioration of the goods passes to the customer only when the goods are handed over.

§9 Warranty
The legal warranty provisions apply.

§10 Liability for Damages

Customer claims for damages are excluded except for damages resulting from injury to life, body, or health.

§11 Cancellation Policy

(1) Consumers are entitled to the statutory right of withdrawal as described below:

Right of Withdrawal

You have the right to withdraw from the purchase contract in accordance with §312g (BGB).
The withdrawal period is fourteen days.
You may withdraw from the purchase contract within the withdrawal period without providing any reasons.
In the case of a purchase contract, the withdrawal period begins on the day you or a third party designated by you, who is not the carrier, takes possession of the goods.
In the case of a contract for multiple goods ordered as part of a single order but delivered separately, the withdrawal period begins on the day you or a third party designated by you, who is not the carrier, takes possession of the last item.
In the case of a contract for the delivery of goods in multiple partial shipments or pieces, the withdrawal period begins on the day you or a third party designated by you, who is not the carrier, takes possession of the last partial shipment or piece.

To exercise your right of withdrawal, you must inform us (Löffler ERGO GmbH, Industriestraße 5, 91217 Hersbruck, Fax: +49 (0) 91 51 – 83 00 8-88, Phone: +49 (0) 91 51 -83 00 8-0, Email: hallo@loeffler.de) of your decision to withdraw from this contract by means of a clear statement. You can use the attached model withdrawal form, but it is not mandatory. You can also send your withdrawal via this link directly through our shop or via post or fax by printing out the appropriate form. If you choose to send the withdrawal directly through our shop, we will promptly send you a confirmation of receipt of such a withdrawal (e.g., by email). To meet the withdrawal deadline, it is sufficient to send the notice of exercising your right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we are obliged to refund all payments we have received from you, including delivery costs (with the exception of any additional costs incurred if you have chosen a different delivery method than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day we receive notice of your withdrawal from this contract. For this refund, we will use the same payment method that you used for the original transaction unless explicitly agreed otherwise; in no case will you be charged fees for this refund.
We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever occurs earlier.
You must return the goods to Hdh Sitzmöbel c/o Löffler ERGO GmbH, Industriestraße 5, Hersbruck, 91217 DE, Email: hallo@loeffler.de, Phone: +49 (0) 91 51 -83 00 8-0, Fax: +49 (0) 91 51 – 83 00 8-88, without undue delay and in any event no later than fourteen days from the day on which you informed us of the withdrawal. The deadline is met if you send the goods before the period of fourteen days has expired.
We bear the costs of the return shipment for the following countries: France, Belgium, Netherlands, Luxembourg, Portugal, Spain, Poland, Hungary, Slovakia, Denmark, Czech Republic, Austria, Switzerland.
You are only liable for any diminished value of the goods if the loss in value is due to handling that was not necessary for examining the condition, properties, and functioning of the goods.

Applicable Law / Jurisdiction

(1) German law shall apply.
(2) For disputes with business customers as defined in § 3 paragraph 1 sentence 3, the place of jurisdiction is Reichenschwand. This does not apply to disputes with customers who are consumers.
